Should I Sign A Release Of Liability?

If you have been involved in a car accident and your insurance company or the insurance company of the at-fault driver asks to you sign a release of liability in exchange for a settlement offer, do not sign the release or accept the offer without first speaking with your lawyer. Many insurance companies are quick to offer a low settlement, or to try and convince an accident victim to sign away his or her rights. They do this in the hopes the victim will believe this is the maximum they should expect and no other offer will be forthcoming.

An accident settlement needs to include an accurate assessment of the repairs your vehicle requires, all current and future medical expenses, any loss of income as a result of the accident, and a variety of other costs relating to injuries sustained in the accident. Even in cases where a victim does not think he or she has suffered injury, there may be medical expenses or accident-related costs which have not yet been determined. Signing a release of liability is beneficial to only one party, the insurance company. You should not rush to accept an insurance company's initial offer or sign away your rights. You have time to review the offer and find out whether accepting it is in your best interests, regardless of what the insurance company may lead you to believe.
