Wrongful Death - $33.3M Wrongful Death Decision Upheld by Court of Appeals

Practicing in a metropolitan area, it is likely that a Detroit personal injury lawyer will represent a number of individuals who have died as a result of another person’s negligence. These cases are particularly tragic because those that suffer do so because of minor mistakes that could have been easily avoided. Pharmacists, in charge of dispensing prescriptions, need to pay the utmost attention to the drugs they administer–otherwise, severe personal injury or death can ensue.

In the recent wrongful death lawsuit against Walgreens, the family of Beth Hippely, 46, was awarded a substantial amount of money for her 2007 death. After being diagnosed with breast cancer, she was prescribed the blood thinner Warfarin. However, she became paralyzed after a teenage pharmacy technician administered a dosage that was ten times the amount originally prescribed. She died in January 2007, after the error caused a cerebral hemorrhage causing permanent bodily disability and pain. By August 2007, the court ruled in favor of the Hippely family.

Walgreens appealed the decision, but to no avail. The Court of Appeals announced on Friday that the lower court handled the medical malpractice case appropriately, and affirmed the award to the Hippely family in the amount of $33.3 million for Beth’s death. The judgment against Walgreens was the largest ever awarded due to prescription error. The personal injury lawyer for the Hippely family commented that “justice has finally been served after eight years in which Walgreens has dragged out this litigation.”

A wrongful death accident is emotionally devastating for the family left behind. Another person’s negligence caused the death of a loved one and answers are always wanted. Therefore, it is essential to contact a hard-working and trustworthy Detroit personal injury attorney for the best legal representation and legal advice available. Doing so can ensure that you receive the most successful outcome for your claim.
